Form I-9 Compliance: A Practical Checklist for Employers

Every U.S. employer must complete Form I-9 for every new hire. Use this checklist to hit the deadlines, avoid common errors and stay audit-ready.

Every employer in the United States must complete Form I-9, Employment Eligibility Verification, for every person they hire — citizens and non-citizens alike. It is a two-page form, but I-9 errors are among the most common findings in government audits, and fines are assessed per form.

Here is a practical checklist to keep your I-9 program clean.

1. Hit the completion deadlines

  • Section 1 must be completed by the employee no later than their first day of work for pay.
  • Section 2 must be completed by the employer within three business days of the employee's first day.
  • If you hire someone for fewer than three days, both sections are due on day one.

2. Review documents correctly

The employee chooses which acceptable documents to present — either one document from List A, or one from List B plus one from List C. Employers may not ask for specific documents or request more than required. Over-documentation can be treated as discrimination.

Examine the documents in person (or through an authorized alternative procedure if you are enrolled in E-Verify and eligible to use it), and confirm they reasonably appear genuine and relate to the employee.

3. Track reverification

When an employee's work authorization has an expiration date, you must reverify by the date it expires. Missed reverifications are one of the easiest violations to rack up — and one of the easiest to prevent with automated reminders.

4. Retain forms for the right amount of time

Keep each I-9 for three years after the date of hire or one year after employment ends, whichever is later. Store forms separately from personnel files so they can be produced quickly in an inspection.

5. Audit yourself before someone else does

Run periodic internal audits to catch missing signatures, blank fields and late completions. Correct errors properly — draw a line through incorrect information, add the correct information, and initial and date the change. Never backdate.

6. Use technology and experts together

Electronic I-9 systems prevent incomplete forms and track deadlines, but judgment calls — unusual documents, remote hires, corrections — still benefit from an experienced reviewer.
