E-Verify vs. Form I-9: What Employers Need to Know

Form I-9 is mandatory for every employer. E-Verify is not — for most. Here is how the two fit together and when E-Verify is required.

Employers often use "I-9" and "E-Verify" interchangeably. They are related, but they are not the same thing — and mixing them up can create real compliance gaps.

Form I-9: required for every employer

Form I-9 is the federal form every U.S. employer must complete for every new hire to verify identity and employment authorization. It is mandatory regardless of company size or industry. See our for deadlines and retention rules.

E-Verify: an online confirmation system

E-Verify is an internet-based system run by the Department of Homeland Security and the Social Security Administration. After Form I-9 is completed, the employer enters information from the form, and E-Verify compares it against government records to confirm employment eligibility.

E-Verify does not replace Form I-9. You still complete, retain and reverify I-9s as usual.

When is E-Verify required?

For most private employers, E-Verify is voluntary. It becomes mandatory when:

  • You hold certain federal contracts that include the E-Verify clause.
  • Your state law requires it — a number of states mandate E-Verify for some or all employers.
  • You are a participant who has enrolled and signed the E-Verify memorandum of understanding.

Rules vary by state and change over time, so review requirements for every state where you employ people.

Rules to follow once you enroll

  • Create an E-Verify case no later than the third business day after the employee starts work.
  • Use E-Verify for all new hires at participating sites — never selectively.
  • Do not use E-Verify to pre-screen applicants before a job offer.
  • Follow the required steps if a case results in a tentative nonconfirmation — the employee has the right to contest it.

Benefits of using both well

Combining an accurate I-9 process with E-Verify reduces the risk of unauthorized employment and can support eligibility for certain remote document examination options. The key is doing both consistently, on time, with clean records.
